Carriage of Goods by Sea Book

The third edition of this classic text has been brought up to date with changes in case law and legislation over the last five years. The section dealing with title to sue has been rewritten in the light of changes following the COGSA 1992. There is a new section dealing with third party "rights" under bills of lading to cover the recent developments in bailment on terms and Himalaya clauses. An account of breach of contract has been added to the chapter on dispute settlement in order to make the treatment of underlying contractual principles self-contained; the effects of the Arbitration Act 1996 have also been reviewed in this chapter. The book is designed to provide a comprehensive and critical survey of the law relating to the carriage of goods by sea. While dealing primarily with charterparties and bills of lading, attention is also devoted to the development of forms of documentation and problems involving through and combined transport, in so far as they relate to the carriage of goods by sea. A final section examines the intricacies of the procedure for dispute settlement. Legal principles are examined throughout against the background of current documentation and contemporary market practice, and this approach is supported by an extensive appendix which include relevant legislation, the Hague/Visby and Hamburg Rules and a wide selection of charterparty and bill of lading forms.Read More
