Modern Banking Law Book

This work is a completely revised and up-dated edition of Modern Banking Law which was published by OUP in 1987. Since 1987 there have been a number of important changes in the law relating to banking especially in respect of banking supervision, credit supervision, secured transactions, and the bank's position as fiduciary agent and constructive trustee. In response, the authors have expanded the text and added new sections where appropriate. In addition, the widespread effects of EC Law have had to be accommodated not only in the existing text but also by way of a new chapter. As a result, the book is even better suited to the purposes for which it was originally intended. It provides students and practising lawyers with an active overview of the different types of banks and bank organizations active in the UK and the legal rules governing their relationships with their customers as well as the relationshiops between banks. In separate sections the book deals with overdrafts and loans, acceptance credits, bills of exchanges, promissary notes, set-off, securities (including floating charges) and the clearing process. Throughout the book, banking law is discussed in the content of its economic function as well as the general legal principles which underpin in the special rules of banking law. In the wake of the spectacular bank failures of the late 1980s and early 1990s (which are examined in some detail), the need for a book of this kind remains as strong as ever. This, the most up-to-date and comprehensive specialised book of the topic, is ideal for both the novice and experienced banking lawyer. This book is intended for practitioners specializing (or intending to specialize) in Banking Law. Students studying for third-year undergraduate and postgraduate courses in Banking Law. Scholars and students studying banking, financial services, consumer credit.Read More
